MINUTES
November 21, 2016
The special meeting of the Stanley County Commission was called to order at 5:01 p.m. (CDT) by Chairman Dana Iversen with Commissioners, Dennis Booth, Craig Heller and Sonny Harrowa. Commissioner Scott Deal was absent. Also present were State’s Attorney Tom P. Maher and Auditor Philena Edwards. The meeting commenced with the recitation of the Pledge of Allegiance.
AGENDA: Motion by Dennis Booth, second by Sonny Harrowa, to approve the Agenda. All voted Aye. Motion Carried.
War Creek Road Project – FEMA Deobligation: Motion by Craig Heller, second by Sonny Harrowa, to approve Resolution 2016-14, War Creek Road Box Culvert Project – Authorization to Proceed with Civil Suit. All voted Aye. Motion Carried.
RESOLUTION 2016-14
WAR CREEK ROAD BOX CULVERT PROJECT –
AUTHORIZATION TO PROCEED WITH CIVIL SUIT
BE IT RESOLVED by the Board of Stanley County Commissioners that Attorney Robert C. Riter, of the Riter, Rogers, Wattier & Northrup, LLP law firm is authorized by this Commission to proceed with a civil lawsuit in the name of and on behalf of Stanley County, South Dakota, in order to seek any and all relief, including, but not limited to, an Administrative Procedure Act claim and declaratory judgment against the Federal Emergency Management, or any other parties, regarding, so called, “deobligation” of the 2011 War Creek Road box culvert project grant funds.
