STANLEY COUNTY COMMISSION

MINUTES

April 28, 2015

 

The special meeting of the Stanley County Commission was called to order at 5:10 p.m. (CDT) by Chairman Scott Deal with Commissioners Dana Iversen, Dennis Booth, Sonny Harrowa and Craig Heller present. Also present were Director of Equalization Roger Fuller, State’s Attorney Tom P Maher, Craig Smith, Dorothy Smith, Tiffany Sanchez, Clint Allman, Orie Bramblee, Lura Kirkpatrick, Crystal Neuharth, Levi Neuharth, and Auditor Philena Edwards. The meeting commenced with the recitation of the Pledge of Allegiance.

 

AGENDA:  Motion by Dennis Booth, second by Sonny Harrowa, to approve the Agenda.  All voted Aye.  Motion Carried.

 

CRAIG & DOROTHY SMITH: Mr. Smith thanked the commissioners for the opportunity to voice his concerns regarding the tax difference between his home and a similar home in his neighborhood where improvements were made. He agrees his assessment is correct.

 

TIFFANY SANCHEZ: Mrs. Sanchez stated their in-town home, Record #8379, has been on the market for a while and would like to see the assessment lowered to Fair-Market Value.

The house they reside in, Record #7530, has had septic problems for almost a year. It has been discovered that it was installed incorrectly so their water use is very limited. They would like the assessment on the house lowered until things are corrected. The commissioners would like more information regarding this issue. This has been tabled for a later date. Mrs. Sanchez thanked the commissioners for their time.

 

Craig & Dorothy Smith – Motion by Dennis Booth, 2nd by Sonny Harrowa, to deny this appeal of assessment because their assessment is correct. All Voted Aye. Motion Carried.

 

Dr. Gonzalo & Tiffany Sanchez – Record #8379 – Motion by Dana Iversen, 2nd by Dennis Booth, to approve this appeal to reduce the assessment by $20,000.00, to lower the assessment to Fair-Market Value. All Voted Aye. Motion Carried

 

Dr. Gonzalo & Tiffany Sanchez – Record #7530 – Tabled until receive more information.

 

Larry Peters – Motion by Dennis Booth, 2nd by Sonny Harrowa, to approve this appeal to reduce the assessment by $18,418, damages sustained from the flood of 2011. All Voted Aye. Motion Carried.

 

Richard Jones – Motion by Dana Iversen, 2nd by Dennis Booth, to approve this appeal to reduce the assessment by $2,000.00. All Voted Aye. Motion Carried.

 

Roy Petersen – Motion by Dennis Booth, 2nd by Craig Heller, to approve this appeal to reduce the assessment by $9,560 due to being over-assessed compared to like properties. All Voted Aye. Motion Carried.

 

Forest Walter – Motion by Craig Heller, 2nd by Sonny Harrowa, to approve this appeal to reduce the assessment by $62,145 due to double land value, incorrect square footage. All Voted Aye. Motion Carried.

 

DEDE Ventures – Motion by Dana Iversen, 2nd by Dennis Booth, to approve this appeal to reduce the assessment by $65,227 due to incorrect occupancy code. All Voted Aye. Motion Carried.

 

Ray Meligan – Motion by Dennis Booth, 2nd by Craig Heller, to approve this appeal to reduce the assessment by $91,344 because the new assessment was not updated. All Voted Aye. Motion Carried.

 

Bob Clair (DOT) – Record #3457 Motion by Craig Heller, 2nd by Dana Iversen, to approve this appeal by deleting this record, as the tower on leased site was removed several years ago.

And Record #3451 assessment to be reduced by $1,987, due to acreage amount incorrectly entered, and the name is to be changed from SDDOT to Bob Clair Jr. All Voted Aye. Motion Carried.

Elderly Assessment Freeze – Motion by Sonny Harrowa, 2nd by Dana Iversen, to approve the list of 15 residents who qualify for the Elderly Assessment Freeze. All Voted Aye. Motion Carried.

 

Disable Veterans List – Motion by Dana Iversen, 2nd by Dennis Booth, to approve the list of 3 residents who qualify for the Disable Veterans List. All Voted Aye. Motion Carried.

 

Tax Exempt – Motion by Craig Heller, 2nd by Dana Iversen, to approve the list of Tax Exempt properties, such as churches, the fire department, etc. All Voted Aye. Motion Carried.

 

These assessments are for 2015 taxes payable 2016.

 

EXECUTIVE SESSION – SDCL 1-25-2(5) – Motion by Sonny Harrowa, 2nd by Dana Iversen, to go into Executive Session at 5:59 P.M. All Voted Aye. Motion Carried.

Motion by Sonny Harrowa, 2nd by Craig Heller, to reconvene at 6:08 P.M. All Voted Aye. Motion Carried.

 

FOUR CORNERS VOLUNTEER FIRE DEPARMTMENT: The fire department found a pickup with a flatbed they would like to purchase. They are working on getting a good, used 600 gallon water tank. The pickup is priced more than the State Bid Law allows. The auditor has been searching for good, used fire trucks and have located a couple.

After much discussion, the auditor will get bids for pickups similar to the one the department located.  Will discuss more at the May 5, 2015 Commissioners Meeting.

 

DISCUSSION: A landowner approached Commissioner Craig Heller regarding the procedure to close a Section Line. They need to talk to the surrounding landowners, hold 2 Public Meetings and talk to Director of Equalization.
